What happened
The Landlord applied to terminate the tenancy because she requires the rental unit for her son's residential occupation. The Tenant challenged the Landlord's status because the Landlord's son is the registered owner of the property, though the Tenant paid rent to the Landlord throughout the tenancy. The Tenant also questioned the good faith of the application, citing previous discussions about selling or rent increases.
The ruling
The LTB ordered the termination of the tenancy effective October 31, 2025, for the purpose of the Landlord's son's occupation. The Tenant is ordered to pay the Landlord $4,197.28 for compensation for use of the unit from February to June 2025, after accounting for the rent deposit and interest. A daily compensation rate of $47.04 applies until the Tenant vacates.
