What happened

The Landlord sought termination of tenancy and compensation for unpaid utility costs and rent arrears. Since the tenancy was already terminated by a previous order and rent arrears were addressed therein, this application focused on whether the guarantor should be named as a tenant and the collection of unpaid utilities. The Tenant alleged the Landlord intentionally shut off power, which the Board found unsubstantiated.

The ruling

The LTB dismissed the Landlord's application for rent arrears as they were already covered by a previous order. The Board determined that the guarantor was not a tenant and excluded him from the order. The Tenant was ordered to pay the Landlord $3,456.88 for unpaid utilities and the application filing fee by November 23, 2025.
