What happened
The Landlord applied to terminate the tenancy because they require the rental unit for their daughter's personal use. The Tenants contested the application, alleging bad faith and citing financial motives following previous rent increase attempts. A preliminary issue arose regarding the Tenants' failure to serve 110 pages of text message evidence to the Landlord, resulting in the exclusion of those documents from the hearing record.
The ruling
The LTB terminated the tenancy effective November 15, 2025, finding the Landlord acted in good faith in reclaiming the unit for their daughter. The Landlord was ordered to pay the Tenants $2,511.00 in statutory compensation. The Tenants were granted a slight delay in eviction until mid-November to account for their health challenges and family situation.
