What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants failed to void the N4 notice before the application was filed and remained in possession of the unit. Tenant 1 testified to financial hardship resulting from a suspension of social assistance and the departure of the other tenant from the unit.

The ruling

The tenancy is terminated effective November 30, 2025, unless the Tenants pay $12,086.00 to void the order. If the Tenants do not void the order, they must vacate by November 30, 2025, and pay the Landlord $7,525.38 for arrears up to the hearing date plus daily compensation of $78.25 until they move out.
