What happened

The Landlord applied to evict the Tenant based on an N6 notice, alleging the Tenant committed an illegal act by stealing a chair from the laundry room. The Tenant contested the allegation, claiming the chair was his own property which he had placed in the laundry room for communal use. The Landlord's application was ultimately dismissed.

The ruling

The Landlord's application to terminate the tenancy and evict the Tenant for an alleged illegal act is dismissed. The Board found that the Landlord failed to provide sufficient evidence to prove their claim that the Tenant stole a chair. The Tenant's testimony that the chair was his own was found to be more credible.
