What happened

The Tenants filed an application claiming the Landlord altered locks without providing keys and substantially interfered with their reasonable enjoyment. Before the hearing, the parties had reached a full and final settlement which included a significant payment to the Tenants and a withdrawal of the application. The Tenants later sought to proceed with the application, alleging the Landlord negotiated in bad faith by not disclosing the pending sale of the property. The Tenants were concerned that a new owner might not honor the settlement's re-application terms or might seek higher rent.

The ruling

The Tenants' application was dismissed. The Board found that the parties had entered into a valid and binding settlement agreement which the Landlord had partially fulfilled through payment. The Landlord's failure to disclose the sale of the building did not invalidate the settlement or constitute bad faith, as the settlement terms remain legally binding on any successor landlord.
