What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. The Tenants were absent from the videoconference hearing. The Landlord and their representative were present. The Landlord's evidence was heard unopposed. The rent arrears are substantial, exceeding the LTB's monetary jurisdiction. The Landlord received an unverified email from the Tenants on the morning of the hearing claiming they had vacated the unit.

The ruling

The tenancy is terminated unless the Tenants pay the full arrears of $41,836.00 by May 27, 2025. If they fail to do so, they must move out by that date, and the Landlord can enforce the eviction. If the tenancy is terminated, the Tenants must pay the Landlord $35,186.00 (the maximum amount allowed by the Board's monetary jurisdiction) plus a daily compensation of $80.55 from May 15, 2025, until they vacate.
