What happened

The Tenants filed a motion to set aside an eviction order issued after they breached a previous payment plan. The breach occurred because of a daily debit limit at their bank when attempting to pay the full arrears. The Tenants, who have a 15-year tenancy and significant health/financial challenges, requested a more affordable payment schedule.

The ruling

The motion to set aside the eviction order (LTB-L-056095-25) is granted. The previous order is cancelled and replaced. The Tenants must pay $5,638.68 in total, consisting of $5,452.68 in arrears and the $186.00 filing fee. A new payment plan is established where the Tenants pay $200.00 toward arrears on the 1st of each month starting October 1, 2025, until January 1, 2028, in addition to their regular monthly rent. Failure to meet these conditions allows the Landlord to apply for an ex-parte eviction order.
