What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served a valid N4 notice, but the Tenant claimed to have paid the rent, though could not provide evidence of the payment. The Tenant was still in possession of the rental unit at the time of the hearing.

The ruling

The tenancy will continue if the Tenant pays the rent arrears of $2,033.14 in installments by March 15, 2024 and pays the monthly rent of $1,089.16 on time. If the Tenant fails to make any of the payments, the Landlord may apply to terminate the tenancy and evict the Tenant.
