What happened
The Tenant applied for an order determining that the Landlord harassed, obstructed, coerced, threatened, or interfered with the Tenant. The Landlord moved to dismiss the application on the basis that no valid cause of action was disclosed and the alleged conduct fell outside the statutory limitation period. The Board found the Tenant failed to provide evidence or specific dates for conduct within the one-year period preceding the application filing.
The ruling
The Tenant's application is dismissed. The Tenant failed to provide evidence of harassment or interference by the Landlord that occurred within the one-year limitation period required by the Residential Tenancies Act, 2006. Allegations regarding an incident in 2020 were barred by time, and no subsequent conduct was substantiated during the hearing.
