What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Landlord served an N4 notice which the Tenants failed to void by paying the arrears. The Tenants did not attend the hearing, and evidence showed significant rent arrears that had increased since the application was filed.

The ruling

The tenancy is terminated effective December 2, 2025, unless the Tenants pay $5,844.00 by November 30, 2025, or $7,846.00 by December 2, 2025. If the Tenants do not pay and the tenancy is terminated, they are ordered to pay $2,931.24 to the Landlord, which accounts for arrears up to the hearing date and the filing fee, minus the rent deposit and interest. Daily compensation of $65.82 applies for each day the Tenants remain in the unit after November 17, 2025.
