What happened
The Landlord applied for an Above Guideline Rent Increase (AGI) based on eligible capital expenditures for a roof replacement at the residential complex. Several Tenants contested the application, raising concerns about the lack of municipal building permits, transparency in communication, and previous board orders they believed barred the increase. The dispute centered on whether the roof work met the statutory requirements for an AGI and which units were subject to the increase based on tenancy start dates.
The ruling
The Landlord is permitted to increase the rent by 0.51% above the annual guideline for eligible units, effective November 1, 2022. The increase is based on a roof replacement project. If a Tenant remains in their unit after the 20-year useful life of the project (ending in 2042), the Landlord must reduce the rent by the AGI percentage. Any overpayments resulting from the retroactive application of this order must be repaid within 90 days.
