What happened

The Landlord applied to terminate the tenancy because the Tenant transferred occupancy of the unit to unauthorized occupants without consent. After an eviction order was issued following a hearing the Tenant did not attend, the Tenant requested a review. The Tenant claimed he was unable to attend the original hearing because he was caring for his ill father and had the flu. The Board considered whether the Tenant exercised due diligence in attempting to participate.

The ruling

The Tenant's request for a review of the order dated February 27, 2025, is denied. The original order, which presumably terminated the tenancy for unauthorized occupancy, remains in full force. The stay of the eviction order is lifted immediately.
