What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. Tenant 1 attended the hearing and explained that he had lost his job in August 2025, which led to the arrears, but had started a new job in October. The Member determined that while a viable payment plan could not be established, it was appropriate to postpone the eviction date to allow the Tenants time to secure alternative housing using their new employment documentation.
The ruling
The tenancy is terminated effective December 4, 2025. The Tenants are ordered to pay $7,457.30 to the Landlord, representing arrears up to the hearing date and the filing fee, minus the rent deposit and interest. The Tenants can void the eviction by paying the full arrears plus filing fees ($12,386.00 by November 30, 2025, or $15,436.00 by December 4, 2025). Daily compensation of $100.27 is required until the unit is vacated.
