What happened
The Landlords applied to terminate the tenancy for persistent late payment of rent and for major renovations requiring vacant possession. The Tenants, who have lived in the unit since 2016, argued that their late payments in early 2025 were due to ODSP scheduling issues and that they have otherwise been reliable tenants. Regarding the renovations, the Landlords failed to provide a valid building permit, which had been revoked prior to the hearing.
The ruling
The LTB granted the Tenants relief from eviction for persistent late payments, provided they pay their rent on time from November 2025 to April 2026. The Landlords' application to evict for renovations (N13) was dismissed because they did not have a valid building permit and failed to demonstrate sufficient due diligence in securing one. The Tenants must pay $186.00 to the Landlords for the filing fee.
