What happened
The Tenant applied for a determination that the Landlord failed to meet maintenance obligations regarding an ongoing ceiling leak and bathroom mould. The Tenant testified the leak persisted since move-in in 2021 and damaged her television and stand. A municipal inspection in 2025 confirmed water damage and mould. The Landlord argued the leak was hard to find and blamed the Tenant for bathroom mould due to her choice of shower curtain.
The ruling
The Landlord is ordered to pay the Tenant $1,967.50 for rent abatement, property damage (TV and stand), and the filing fee. The Landlord must also complete all ceiling repairs and ensure the bathroom is mould-free by August 31, 2025. If the repairs are not completed by that date, the Tenant is authorized to deduct $50.00 from the monthly rent starting September 1, 2025, until the work is finished.
