What happened

The Landlord sought to terminate the tenancy due to non-payment of rent following a significant rent increase. The Tenant disputed receiving the rent increase notice (N2), despite evidence of service via text and messaging apps. The unit was found to be partially exempt from rent control as it was first occupied for residential purposes after November 15, 2018.

The ruling

The tenancy is terminated effective August 31, 2025. The Tenant is ordered to pay $6,132.88 in arrears up to the hearing date. The Tenant can void the order by paying the escalating amounts specified in Schedule 1 by the end of each month. Due to the Tenant's vulnerability and serious medical condition, the eviction was postponed to August 31, 2025, to provide additional time to find housing.
