What happened

The Tenants requested a review of an eviction order issued for non-payment of rent. They claimed that the original order contained a serious factual error regarding the amount of arrears and that they were unable to participate in the initial hearing. Upon review, the LTB member found that the Landlord had failed to account for substantial payments made by the Tenants in the L1 update sheet provided at the original hearing. Since the Tenants subsequently paid all remaining arrears and costs, the original eviction order was cancelled.

The ruling

The request for review is granted, and the original order LTB-L-009123-25 is cancelled and replaced. The Landlord's application for termination and eviction is dismissed because the Tenants have satisfied the arrears in full.
