What happened
The Tenant requested a review of an order dated May 20, 2025, which had terminated the tenancy for non-payment of rent. The Tenant claimed they did not receive notice of the original hearing. A preliminary issue was raised regarding the identity of the Landlord, as Landlord 1 filed the application while Landlord 2 was the registered owner. The Adjudicator addressed the authority of Landlord 1 as an agent and the Tenant's inability to participate in the previous proceeding.
The ruling
The LTB granted the Tenant's request for review of the eviction order issued on May 20, 2025. The Board found the Tenant did not receive notice of the original hearing. The original order is cancelled, and a new hearing will be scheduled. The Tenant is ordered to pay ongoing rent as it becomes due until the matter is resolved. The application was also amended to include both Landlords as parties.
