What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to serious impairment of safety and substantial interference with reasonable enjoyment. The Landlord lives in the upper unit of a three-unit building, and the Tenant lives in the basement. Following a disruptive argument between the Tenant and an occupant, police attended the residence multiple times, eventually deploying a tactical unit, twenty vehicles, and ambulances to search for the Tenant. The Landlord and his family were advised to evacuate their home for safety. The Landlord also claimed damages to the unit.
The ruling
The tenancy is terminated effective November 1, 2025, due to substantial interference with the Landlord's enjoyment. The Tenant is ordered to pay $4,777.07, which accounts for daily compensation and the application fee, minus the rent deposit and interest. If the Tenant does not vacate, the Landlord may enforce the eviction through the Sheriff on or after November 2, 2025.
