What happened

The Tenant applied for an order determining that the Landlord collected or retained money illegally by failing to provide the mandatory one month's rent compensation after serving an N12 notice for personal use. The Landlord admitted to serving the notice but argued that because the Tenant stayed past the termination date and provided short notice of her eventual departure, the compensation was not owed. The Board determined that under the Act, the obligation to pay compensation is mandatory once the N12 notice is served and is not contingent on the tenant's move-out date.
