What happened
The Landlords applied to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant raised Section 82 issues concerning maintenance, specifically water stains, a drywall crack, a roof leak, and hardwood flooring issues. The Tenant sought relief from eviction due to financial hardship related to WSIB benefits and his young son's residency.
The ruling
The Tenant is ordered to pay $4,917.22 in arrears and costs via a monthly payment plan of $150.00 in addition to regular rent, starting August 15, 2025. Relief from eviction is granted provided the Tenant adheres to the payment schedule and pays ongoing rent on time. If the Tenant defaults, the Landlords may apply for an ex parte eviction order within 30 days of the breach. The Tenant's maintenance-related claims for rent abatement were dismissed.
