What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to rent arrears. Despite being served with notice of the hearing and a letter from the Landlord inviting a payment plan, the Tenant did not attend the hearing. The Tenant had made a significant payment of $6,000.00 after the application was filed, but arrears remained.

The ruling

The tenancy is terminated effective September 15, 2025, unless the Tenant voids the order by paying $2,193.00 by August 31, 2025, or $4,194.00 by September 15, 2025. If the Tenant fails to pay and the tenancy terminates, the financial calculation shows that because of the deposit and the large $6,000.00 payment, the Landlord would actually owe the Tenant $984.57 (subject to daily compensation of $65.79 for staying past August 13).
