What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing, but was incarcerated.
The ruling
The tenancy is terminated unless the Tenant pays $11,706 by March 31, 2024 or $12,986 by April 8, 2024 to void the order. If the Tenant does not void the order, they must vacate by April 8, 2024 and pay the Landlord $8,681.76 plus daily compensation of $42.08 from February 21, 2024 until move-out.
