What happened
The Landlord applied for an order to terminate the tenancy based on an agreement signed by one of two Tenants. The other Tenant had previously vacated the unit and communicated her abandonment of the tenancy. The Landlord sought a formal order confirming their right to possession. The Tenants did not attend the hearing.
The ruling
The tenancy was officially terminated on March 31, 2025. The Board found that one co-tenant had abandoned her interest, making the termination agreement signed by the remaining tenant valid to end the entire tenancy. The landlord's request for the application fee was denied as the tenants had already moved out.
