What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Landlord served a valid N4 notice which was not voided by the Tenant. The Tenant, who attended the hearing, sought relief to postpone the eviction citing financial hardship and potential homelessness.
The ruling
The LTB ordered the termination of the tenancy effective December 31, 2025, unless the Tenant voids the order by paying the full arrears. Due to the Tenant's financial circumstances and risk of homelessness, the adjudicator granted relief from immediate eviction. If the Tenant does not void the order, they are required to pay $9,741.77, which represents arrears and the filing fee minus the security deposit.
