What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to rent arrears. During the hearing, the Tenant confirmed she intended to vacate the unit by September 14, 2025, as she no longer wished to reside there. The Landlord requested termination for that date. The LTB found the N4 notice valid and calculated the total arrears, considering payments made since filing and the last month's rent deposit.
The ruling
The tenancy is terminated effective September 14, 2025. The Tenant is ordered to pay $691.01 if the tenancy is terminated (calculated after applying the rent deposit and interest). Alternatively, the Tenant can void the order by paying $5106.00 on or before September 14, 2025. Daily compensation of $80.88 applies from August 22, 2025, until the unit is vacated.
