What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to substantial rent arrears. The Tenant, who has lived in the unit for over 21 years with her two adult children, admitted to owing rent but disputed the total amount without providing evidence. The Tenant is currently unemployed and receiving social assistance. The Landlord provided a detailed ledger and, while seeking eviction, requested a delayed date to allow the Tenant extra time to pay the debt and potentially maintain the tenancy.
The ruling
The tenancy is terminated effective December 31, 2025, unless the Tenant pays $7,775.69 on or before that date to void the order. If the Tenant fails to pay and does not vacate, the Landlord can enforce the eviction through the Sheriff starting January 1, 2026. If the tenancy is terminated, the Tenant is ordered to pay the Landlord $3,397.30 (representing arrears minus the deposit and interest) plus daily compensation of $48.87 from October 31, 2025, until move-out.
