What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant failed to attend the hearing despite being properly served. Evidence presented showed that while some payments were made after the application was filed, a substantial balance remained. The Landlord also testified that attempts to negotiate a repayment plan were ignored by the Tenant.
The ruling
The tenancy is terminated effective November 2, 2025, unless the Tenant pays $2,709.90 by October 31, 2025, or $3,732.83 by November 2, 2025, to void the order. If the Tenant does not void the order and does not vacate, the Landlord can enforce eviction through the Sheriff. In the event of termination, the Tenant is ordered to pay the Landlord $691.68 plus daily compensation of $33.63 until they move out.
