What happened

The Landlord applied to terminate the tenancy and evict the Tenants for non-payment of rent. The Tenants contested the arrears, which were largely affected by a previous Above Guideline Increase (AGI) order. Following a review and a de novo hearing, the Board determined that the Landlord's calculations were correct and that valid notice was served. Tenant 1 cited unemployment and health issues as reasons for the arrears. The Board granted a postponement of the eviction to allow the Tenants time to find funds or alternative housing.

The ruling

The tenancy is terminated unless the Tenant pays $8,619.87 by December 31, 2025, or $10,814.68 by January 31, 2026, to void the order. If the order is not voided, the Tenants must vacate by January 31, 2026, and pay the Landlord $3,648.58 plus daily compensation of $72.16 from November 21, 2025, until they move out.
