What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. One tenant had vacated the unit prior to the hearing, but the other tenant remained in possession.

The ruling

The tenancy is terminated unless the Tenants pay $9,966 by February 29, 2024 or $11,116 by March 2, 2024 to void the order. If the Tenants do not void the order, they must vacate the unit by March 2, 2024 and pay the Landlord $8,384.39 plus daily compensation.
