What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. A preliminary issue was whether one Tenant, who had vacated the unit in May 2024, should be removed from the application. The Board ruled that as a joint tenant who unilaterally vacated, she remains jointly and severally liable for the rent. The application was filed within one year of her vacating, giving the Board jurisdiction to order arrears against her.

The ruling

The tenancy is terminated unless the Tenants pay the full amount owing to the Landlord. The Tenants can void the order by paying $12,346.00 by June 30, 2025, or $13,861.00 by July 6, 2025. If they fail to do so, they must vacate by July 6, 2025, and pay the Landlord $7,950.43 plus daily compensation of $49.81 from April 4, 2025, until they move out. The Board confirmed that a joint tenant who moves out remains liable for the rent.
