What happened
The Landlord applied to evict the Tenant for personal use of the rental unit by the Landlord's son. The Tenant appealed the Landlord and Tenant Board's eviction order to the Divisional Court. The Landlord brought a motion to quash the appeal.
The ruling
The Divisional Court quashed the Tenant's appeal of the Landlord and Tenant Board's eviction order. The court found that the appeal did not raise any questions of law and was an abuse of process. The automatic stay of eviction was lifted, allowing the Landlord to file the eviction order with the Sheriff on September 30, 2020. The Tenant was ordered to pay $7,000 in costs to the Landlord.
