What happened

The Tenant filed T6 and T2 applications following a flood on November 23, 2023, caused by sprinkler damage in an upper unit. The flood rendered the rental unit uninhabitable for nearly four months, forcing the Tenant and his family (including a pregnant wife and three children) to live in motels and temporary housing. The Tenant sought rent abatement, compensation for out-of-pocket expenses for food, internet, and motels, as well as damages for pain and suffering.

The ruling

The Landlords are ordered to pay the Tenant a total of $9,371.87 by November 11, 2025. This includes $5,089.87 for rent abatement and accommodation expenses, $3,234.00 for food and internet, $1,000.00 in general damages for pain and suffering, and the $48.00 application fee. If the Landlord fails to pay, the Tenant is authorized to deduct the amount from future rent payments starting December 1, 2025.
