What happened
The Landlord requested a review of an order that set aside an eviction. The Tenant had attempted to void an eviction for rent arrears by providing a bank draft via an occupant on June 16, 2025. The Landlord refused the payment, fearing it would create a tenancy for the occupant, and proceeded with a Sheriff eviction on the morning of June 17, 2025. A previous LTB order found this refusal to be an abuse of process and restored the Tenant to the unit. The Landlord sought to overturn that restoration.
The ruling
The request for review by the Landlord is denied. The previous order issued on July 25, 2025, which set aside the eviction and restored the Tenant to the rental unit, is confirmed. The adjudicator found that the Landlord's decision to refuse a voiding payment and proceed with the Sheriff's eviction was an abuse of process.
