What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. Tenant 1 testified that she had verbally notified a receptionist of her intent to move out and claimed to have vacated the unit on August 1, 2025. The Landlord disputed receiving any such notice. The LTB found the Tenant's testimony regarding the notice not credible and determined the tenancy was not lawfully terminated, making the Tenants liable for rent arrears.
The ruling
Unless the Tenants pay $9,608.75 to void the order by November 24, 2025, the tenancy is terminated. If not voided, the Tenants must move out by the same date and pay the Landlord $4,922.69, which represents arrears and filing fees minus the rent deposit and interest. Daily compensation of $61.96 applies from October 15, 2025, until the unit is vacated.
