What happened
The Landlord, a corporation, applied to evict the Tenant for non-payment of rent. At the hearing, the Tenant requested an adjournment to raise issues under section 82 of the Residential Tenancies Act, but the request was denied. The Board member found the Tenant had not complied with the rules for raising such issues and did not provide a satisfactory reason for the failure. The hearing then proceeded on the Landlord's application regarding the rent arrears.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the arrears in installments, starting with $9,274.10 by April 30, 2025. If the Tenant fails to pay and does not move out by June 16, 2025, the Landlord can enforce the eviction. If the tenancy ends, the Tenant is ordered to pay the Landlord $6,788.45. The adjudicator granted a delay in eviction to June 16, 2025, as a form of relief, acknowledging the Tenant's 30-year residency in the unit.
