What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had been removed from the rental unit by police in September 2022, but her possessions remained in the unit and she had not returned the keys to the Landlord.
The ruling
The tenancy is terminated unless the Tenant pays $7,386 to void the order by June 12, 2023. If the Tenant does not pay, they must vacate the unit by June 12, 2023 and pay $5,518.71 in rent arrears and application fees, plus daily compensation of $19.73 from March 28, 2023 until move-out.
