What happened
The Tenant applied for remedies alleging the Landlords failed to meet maintenance obligations regarding pests (cockroaches and bedbugs), garbage disposal, and unit repairs (broken closet). The Tenant also alleged harassment through frequent phone calls regarding rent arrears and the service of invalid termination notices. Additionally, the Tenant raised concerns about a lack of heat, hot water, and laundry facility issues. A preliminary issue regarding the adjudicator's potential bias was raised because the same member had presided over a previous arrears case involving the same parties.
The ruling
The Landlord (Northern Diversified Ltd.) is ordered to pay the Tenant a rent abatement of $88.74 for failing to address a cockroach infestation in a timely manner. All other claims by the Tenant, including harassment, lack of heat, and other maintenance issues, were dismissed. The payment may be deducted from existing arrears under a separate LTB order.
