What happened
The Landlord applied to terminate the tenancy due to non-payment of rent. Following a series of previous orders and amendments, the parties appeared for an amendment hearing which was converted by consent into a review hearing. The parties reached a consent agreement regarding massive rent arrears totaling $47,000.00. The order sets out specific payment terms for the Tenant to void the eviction, while noting the LTB's $50,000.00 jurisdictional limit on monetary awards.
The ruling
The LTB issued a consent order replacing a previous amended order. The Tenant is found to owe $47,000.00 in rent arrears. To void the eviction and continue the tenancy, the Tenant must pay $47,000.00 by October 15, 2025, or $55,000.00 by November 15, 2025. If the Tenant fails to void the order, the tenancy terminates on November 15, 2025, and the Tenant must pay the Landlord $50,000.00 (the maximum LTB jurisdictional limit) plus $340.00 in costs.
