What happened

The Landlord applied for rent arrears after the Tenant vacated a rental unit early during a fixed-term lease. The Tenant requested a review of an earlier order, claiming they were unable to attend the original hearing. In the new hearing, the Tenant argued they were entitled to terminate early because the Landlord failed to respond to a lease assignment request. The Landlord denied receiving an assignment request and demonstrated they attempted to mitigate damages by advertising the unit. The Board found the Tenant failed to prove the assignment request and upheld the Landlord's claim for arrears up to December 2024.

The ruling

The original order was cancelled and replaced. The Tenant is ordered to pay $4,603.00 to the Landlord by September 15, 2025. This amount covers rent arrears up to December 31, 2024, NSF charges, and the application fee, with the rent deposit and interest applied as a credit.
