What happened

The Tenant requested a review of a previous LTB order that terminated the tenancy for persistent late payment and rent arrears. The Tenant argued that the original presiding Member failed to consider issues raised under Section 82 of the Act. The review Member found that the original Member was correct to exclude these issues because the Tenant had failed to provide sufficient particulars, which prevented the Landlord from preparing a proper response. Consequently, the request for a review was denied as no serious error was found.

The request to review order LTB-L-049823-25 is denied. The original order, which terminated the tenancy effective August 31, 2025, for persistent late payment and non-payment of rent, remains in full force and effect. The Tenant failed to demonstrate that a serious error occurred during the original hearing or in the resulting order.
