What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to substantial rent arrears and persistent late payments. The Tenant had failed to pay rent on time 17 times out of the last 19 months and owed over $22,000 in arrears at the time of the hearing. The Tenant cited disability as a factor and proposed a payment plan for September, but the Board found it unfair to grant relief from eviction due to the size of the debt and a previous failed promise to pay.
The ruling
The tenancy is terminated effective September 2, 2025. The Tenant can void the eviction by paying $24,636.00 by September 2, 2025. If the Tenant does not pay and does not move out, the Landlord can enforce the eviction through the Sheriff starting September 3, 2025. If the Tenant voids the eviction, the tenancy continues on the condition that future rent is paid on time for one year; failure to do so allows the Landlord to apply for eviction without notice.
