What happened

The Landlords applied to evict the Tenant for rent arrears. The Board determined the Tenant, who initially remained in the unit as an unauthorized occupant after the original tenant left, was deemed to be an assigned tenant under the Act. The Landlords' N4 notice was found to be defective because it stated an incorrect rent amount. Consequently, the application for eviction was dismissed, but the Board issued a monetary order for the rent arrears and the application fee.
