What happened

The Landlord applied to evict the Tenant for substantial interference due to the Tenant's dog's behavior. The Landlord served two N5 notices: the first for the dog being unleashed in hallways, and the second for excessive barking on the balcony. After the notices, another incident occurred where the unleashed dog approached a two-year-old child. The Tenant did not attend the hearing.

The ruling

The adjudicator found that the Tenant intentionally disobeyed instructions to leash the dog even after formal notices, and therefore declined to issue a conditional order.
