What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant, and for an order to have the Tenant pay the rent they owe, because the Tenant failed to meet a condition specified in the order issued by the Board on September 5, 2023 with respect to application LTB-L-032383-23.

The ruling

The Tenant's review request is denied. The February 26, 2024 Member Direction denying the Tenant's request to extend time to file a set aside motion is confirmed. The January 12, 2024 ex parte eviction order is also confirmed. The interim order issued on March 4, 2024 is cancelled, and the stay of the January 12, 2024 order is lifted immediately.
