What happened

The Landlord filed two applications: one for non-payment of rent (L1) and another for persistent late payment of rent (L2). There was a dispute over the lawful rent amount, with the Tenant believing it was $750 and the Board determining it to be $900. The Board dismissed the L2 application, finding that the issue was non-payment rather than late payment, which deprived the Board of jurisdiction for that application. The L1 application for non-payment was granted, resulting in a conditional order for the Tenant to pay the arrears to avoid eviction.

The ruling

The Landlord's application for persistent late payment (L2) is dismissed. The application for non-payment of rent (L1) is granted. The tenancy is terminated unless the Tenant pays the Landlord $13,536.00 on or before June 30, 2025. If the Tenant does not void the order, they must move out by June 30, 2025, and pay the Landlord $3,149.56, plus daily compensation of $29.59 from August 14, 2024, until they vacate.
