What happened

The Tenant requested a review of an order terminating the tenancy for non-payment of rent. The Tenant argued that while payment was made after the deadline, the Landlord was aware it was coming from Ontario Works and should not have proceeded with eviction enforcement. The Landlord maintained that the payment deadline was missed and they acted within their rights to enforce the order.

The ruling

The Tenant's request for review is denied. The original order issued on April 2, 2025, which terminated the tenancy for non-payment of rent, is confirmed. The stay of eviction is lifted immediately. The Tenant may still attempt to void the order under section 74(11) of the Act by paying all amounts owing before the Sheriff enforces the eviction.
