What happened
The Landlords applied for termination of tenancy and eviction due to the Tenant's failure to pay rent. The Tenant had not made any rent payments for over six months, resulting in substantial arrears. During the hearing, the Tenant attempted to raise maintenance or other issues under section 82 for a rent abatement, but this was refused as the Tenant failed to provide the required seven-day notice and evidence to the Landlords and the Board. The Tenant cited financial difficulties due to vehicle repairs and the need to care for elderly parents, requesting a stay of eviction until November 2025.
The ruling
The tenancy is terminated effective July 31, 2025. The Tenant is ordered to pay $9,176.55 to the Landlords for rent arrears and the application fee, after deducting the rent deposit, interest, and a $2,500.00 N12 compensation credit. To void the eviction, the Tenant must pay $12,686.00 by June 30, 2025, or $15,186.00 by July 31, 2025.
