What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.

The ruling

The Tenant did not demonstrate the ability to fully pay the $16,466 owed by July 31, 2024 or the $18,046 owed by August 5, 2024 to void the eviction order. The Tenant's proposed $500/month payment plan was found unreasonable. Relief from eviction was denied, and the tenancy will be terminated if the Tenant does not make the required payment by the deadlines.
